I thought an answer was required within 45 days of the Department of Planning giving their approval?

Has anyone seen the online document that the guys on the other forum have found?

Approval document dated September 14th or 12th from memory....

Sign of things to come maybe?

Speculation anyway.

If you look at the DOP's actual recommendation (see attached) you will notice that the document was signed on 15/6/2012.

dop-recom.jpg

The date of the recommended instrument is 14/09/2012. This is exactly 3 months after the date of DOP D/G's signing. Standard practice.

What you're looking at is purely an intended instrument. The date that will be inserted into that document is entirely arbitrary and will change depending on what date the PAC chooses to sign that instrument - or, more likely, an amended instrument. The PAC panel may choose to reject the proposal and not sign any instrument.

The PAC instrument (the actual final and legally signed determination) will also included the names of the three panelists who are making the determination.

The document that has been recently "discovered" has been sitting on the DOP website since 2 July 2012. Nothing new there.

We're still looking towards a determination being made before the end of August.

Steady as she goes.

Thanks fitz, good explanation. It'd help on that Major Projects site if they showed what date each document was uploaded/modified. Very confusing!

Fitz, can the PAC as part of its determination approve the project but direct the proponent to reduce the scale of the residential or is it simply going to be a 'yes' approved in full or 'no' rejected on the preferred plan that has been submitted.

PAC has the delegation and authority to say Yes, No or Conditional Yes.

The DOP D/G's recommeded Instrument of Approval has a lot of included conditions.

I'm sure PAC will have some that they wish to have included also.

Good to hear we are hoping for end of August, the suspence is killing me. Mind you as long as it gets approved that's what matters.

For anyone interested...

The Kirrawee Brick Pit Development has received a Determination on 23 August 2012.

It can be found at: http://www.pac.nsw.gov.au/DesktopModules/PAC_Review_Monitoring/getdocument.aspx?docid=764 and http://www.pac.nsw.gov.au/DesktopModules/PAC_Review_Monitoring/getdocument.aspx?docid=765

Given that this proposal was submitted to PAC a day after the Sharks Development proposal, I can only imagine that we're not too far off seeing a determination on the Sharks proposal soon.

Fingers crossed.
